Lake Co., In, Wills This is the will of my great grandfather, Jacob Fauser. Jacob Fauser signed his last will and testament June 20, 1911, at the age of 81, nearly 2 1/2 years before he died. It read as follows: I, Jacob Fauser, at this time a resident of Lake County, Indiana, and, being of sound and disposing mind and memory, do make, publish and declare this to be my last will and Testament, hereby revoking all former wills by me made: Item 1. It is my will and I direct my Executors hereinafter appointed, to first pay from my estate all my just and legal debts including the expenses of my last sickness and funeral. Item 2. I give and bequeath unto my son, Mathew Fauser, the sum of Seven Hundred ($700) Dollars. This bequest is made for the reason that I have heretofore advanced to my said son a sufficient amount to make his share equal with my other children, and for that reason I have only bequeathed to him the amount heretofore stated in this item, and he shall have no other part of my estate whatsoever. Item 3. I give and bequeath unto my grandchildren, Thomas Mack, Clarence Mack and Earl Mack, each, the sum of Three Hundred ($300) Dollars, and this shall be in Lieu of all their interest in my estate, and my said grandchildren in this item named being the children of my deceased daughter, Mary Mack. Item 4. I give, bequeath and devise the remainder of my estate, both real and personal, unto my beloved children Katherine Fatch, Lydia Stephens, Matilda J. Elliott, Laura Hansen, Christina Becker, Sarah Bloomingdaul, Charles Fauser, James Fauser and Edward Fauser, to share and share alike, and my said children in this item named to have all of my real estate and to hold the same in fee simple, and they, my said children, herein named to have all of my personal estate absolutely. Item 5. It is my will and I hereby direct that should and of the legatees herein named institute or commence any proceedings of any kind, nature, or description whatsoever, in any court in the State of Indiana, or in the United States of America, to contest this my last will and testament, the share herein bequeathed and devised to the one or ones commencing such proceedings, shall go to the others herein named in equal shares, and the one so contesting, or commencing any proceedings for that purpose, shall have no part or share of my estate whatsoever. Item 6. I constitute and appoint my son-in-laws Joseph I. Elliott and William T. Stephens, executors of this my last will and testament.
